Illinois Rent Deposit

 

The landlords collect a security deposit from all the tenants and this is misunderstood as an advance rent. No way it can be adjusted with the previous month unpaid rent. This amount will be used when there is any damage caused by the tenant. In Illinois there is no maximum or minimum security deposit amount. The usual amount is one or two months rental charge. The amount will be the tenants property. The deposited amount must be returned back within a period of time since evacuation of the tenant. If any delays are caused, then legal actions may be taken against the landlord.

 As per the law, the landlord should issue receipts of damages caused and an itemized statement of damages on the estimated cost within 30 days from the date the tenant vacates. If there are no such issues, the landlord must return the deposit within 45 days from the date of evacuation of the property. In case, if the landlord refuses to settle the amount, the tenant has full rights to file a case and ask as much double the amount of deposit plus the court fees and the attorney fees. The first step to recovering a security deposit is to find a copy of your lease, security deposit receipt and cancelled checks as well as your landlords name, address, and telephone number.
